The California 1st District Court of Appeal overturned a decision by the Workers' Compensation Appeals Board awarding an injured law enforcement officer 104 weeks of temporary disability benefits after he had collected 52 weeks of salary continuation benefits for a knee injury which continued to prevent him from working.In a published decision Tuesday, the 1st DCA's Division 4 concluded that salary continuation benefits paid to Alameda County Deputy Sheriff Bryan Knittel counted toward the Labor Code's 104-week limit on payments for an injury causing temporary disability.
