The Virginia Supreme Court held that without a contractual agreement connecting two parties as "fellow employees," the exclusivity provision of the Workers' Compensation Act does not apply. In Hudson v. Jarrett, No. 040433, 01/14/2005, Hudson, an employee of Universal Maritime Services Corporation (Universal), was loading and unloading cargo from a ship owned by Columbia Coastal Transport LLC (Columbia) when his vessel collided with another vessel.
