The Pennsylvania Supreme Court has granted review of disagreement over the proper prescription drug fee schedule for resolving workers’ compensation disputes.
In January, the Commonwealth Court held that Red Book values are not an accurate average wholesale price and ordered the Bureau of Workers’ Compensation to identify a new, nationally recognized schedule of pharmaceutical costs to resolve payment disputes.
Federated Insurance Co. petitioned the state Supreme Court for review in February, and the court granted it on Tuesday.
