1st DCA To Review Whether Voc Expert Testimony Can Rebut DFEC

The California 1st District Court of Appeal will weigh in on a dispute over whether the opinion of a vocational expert can be used by an applicant to rebut the Diminished Future Earning Capacity component of the 2005 Schedule for Rating Permanent Disabilities. The petition for review in Contra Costa County v. WCAB (Dahl), No. A141046, has been pending for almost a year now. Several amicus briefs were filed urging the court to grant review.
