The federal Office of Workers' Compensation Programs is withdrawing a proposal to adjust penalty provisions in the Longshore and Harbor Workers' Compensation Act.
OWCP in September 2023 announced plans to set a cap of $28,304 for knowingly and willfully failing to submit required injury reports. The agency also proposed assessing penalties as a percentage of the maximum fine, starting with 5% for the first violation and escalating to 80% for a fifth. Employers with six or more violations would receive the maximum fine under the 2023 proposal.
