A divided West Virginia Supreme Court ruled that a worker was not entitled to an increase in his permanent partial disability award for occupational pneumoconiosis. Case: Hoskins v. American Electric Power Co. Inc., No. 22-0500, 01/25/2024, published. Facts and procedural history: Edward L. Hoskins received a 10% permanent partial disability award in 2016 for occupational pneumoconiosis. Hoskins petitioned to reopen the claim in 2018, but he was found to have been fully compensated by the prior award in an order issued by a claims administrator for American’s insurance provider. ...
