A California appeals court affirmed a trial court’s decision dismissing a tort complaint filed by a school maintenance worker who was kicked in the groin by the principal.
The 2nd District Court of Appeals said there was no evidence of any due process violations with the trial court granting the school operator’s demurrer. And the court said the causes of action were time-barred because kicking someone in the groin doesn’t constitute the type of sexual assault for which there is an extended statute of limitations.
