Exclusivity Didn't Bar Mother's Wrongful Death Claim from Workplace Shooting

The Court of Appeals this week ruled that the exclusive remedy provision of the Georgia Workers' Compensation Act did not bar a mother's tort suit over the murder of her son almost exactly four years ago. The mother of slain warehouse worker Nickifor Zephyrine contends that a proper background check would have revealed that the man who murdered her son had a history of felony crimes and was using a fake identity.
