The New Mexico House of Representatives passed a bill that would create a COVID-19 presumption after it was expanded to include essential workers and other employees of businesses currently operating in a limited capacity because of the pandemic.
The House on Monday voted 38-27 to pass HB 268, by Rep. Dayan Hochman-Vigil, D-Albuquerque.
The bill would create a presumption that COVID-19 is compensable unless rebutted by evidence that the worker engaged in conduct or activities outside of employment that substantially violated the public health orders related to COVID-19.
