A convicted California fraudster is asking the U.S. 9th Circuit Court of Appeals to decide how losses should be calculated in fraud cases and whether doctors convicted of paying for patient referrals should receive a credit for the fair market value of the services that were provided.
Dr. Ronald Grusd is arguing that improper instructions allowed a federal jury to convict him on 39 counts despite insufficient evidence of his guilt. He also says the 10-year sentence handed down in June was based on an erroneous calculation of losses flowing from the scheme.
