CA 2nd: CCP Procedure Req'd for Subro Judgment

The Second Appellate District for California ruled yesterday that in a workers' compensation subrogation case the noticed motion procedure set forth in Code of Civil Procedure section 724.050 is the exclusive method for obtaining an order for entry of satisfaction of judgment, but that where failure to comply with the procedure did not result in any prejudice judgment is otherwise affirmed.In Michael Quintana vs. Gregg Whitaker Gibson (B162688, 11/06/03), Quintana was injured in the course and scope of his employment as a result of an automobile accident.
