On October 4, 2003, Gertrude K. Godfrey filed a petition for declaratory judgment and injunctive relief in district court against the State. Godfrey is a resident of Sioux City and a taxpayer in this state. Godfrey claimed House File 2581 violated the single-subject rule of article III, section 29 of our state constitution. At least one state has even applied the exception to a challenge to a broad economic development statute claimed to be enacted in violation of the single-subject requirement of the state constitution. Finally, in a recent item-veto case brought by state legislators individually and in their capacity as state legislators, we found the legislators had standing to maintain the action.
