High Court Says Labor Law Does Not Cover Ordinary Vehicle Repair Work

New York’s highest court ruled that the Labor Law was not intended to cover ordinary vehicle repair work. Case: Stoneham v. Joseph Barsuk Inc., No. 94, 12/19/2023, published. Facts: Mark A. Stoneham is a certified diesel technician. David J. Barsuk hired him to repair the air brake system on a commercial trailer. Stoneham used a front loader, equipped with a bucket attachment, to lift the trailer about 5 feet off the ground, then engaged the loader's parking brake and climbed underneath the trailer.
