Thousands of injured workers who have pending claims will be limited to just four years of benefits instead of eight, thanks to a Kentucky Supreme Court ruling Thursday that reversed part of an appeals court decision.
The ruling in Lafarge Holcim v. James Swinford is seen as a win for employers, and means that a controversial law passed last year limiting the duration of benefits for many pending claims is, in fact, retroactive.
