Measures Propose to Define Employee, Create Presumptions and Finance Old Fund

Lawmakers in West Virginia this year will hear measures that would create a 20-factor test to decide whether a person is an employee covered by workers’ compensation, add three types of cancer to the list of conditions presumed to arise out of employment for firefighters and allow the insurance commissioner to move money into the state’s “old fund.” Senate Bill 545, which would create a funding source for the old fund, is the only measure to have passed out of the house of origin.
