Concrete Company Misclassified Workers, Underreported Payroll, Indictment Says

The Manhattan district attorney this week announced the indictment of a commercial construction company and six of its employees for alleged misclassification of workers, including the misclassification of one who was killed on the job.

CRV Precast Construction is charged with classifying workers as lower-skilled, which allowed lower workers' compensation premiums, and with falsifying information, the prosecutor's office said in a bulletin. 

“Time and again, we’ve seen how wage theft is symptomatic of an overall disregard for workers’ well-being: On worksites where companies regularly defraud their employees, we have also seen them playing fast and loose with their workers’ lives and safety,” said District Attorney Cyrus Vance Jr.

By underreporting payroll, the company underpaid the New York State Insurance Fund by $380,000, and by misclassifying workers as concrete laborers and insuring them at the lower rate, CRV fraudulently lowered its premiums, prosecutors said.
