Court Rejects Civil Suit based on Employer's Alleged Bad Faith

A hospital employee's claim that her employer committed fraud, was negligent and violated the Connecticut Unfair Trade Practices Act by attempting to delay and deny treatment for a workplace injury was barred by workers' compensation exclusivity, the state appellate court ruled. In a decision set for publication on Tuesday, the court said Sandhya Desmond's allegations were "the kind of assertions that routinely are made in workers' compensation cases," and the dismissal of her claims did not violate her constitutional right to due process.
