A Texas appellate court wiped out an order awarding attorney fees to an injured worker after finding state agencies have sovereign immunity that shields them from statutory provisions intended to shift the cost of appeals from injured workers to their employers.
Amendments enacted in 2019 that, among other things, repealed a statute shielding municipalities and political subdivisions of the state from paying fees or fines arising from a workers’ compensation claim do not apply to the University of Texas system because it is a state agency, the 5th District Court of Appeals said.
