A California appellate court has ordered publication of its decision from last month overturning a jury’s $150 million verdict in favor of the family of a worker killed in a power plant explosion.
The original opinion in Collins v. Diamond Generating Corp., No. G062752, from the 4th District Court of Appeals Division 3, was unpublished. Only published decisions are binding precedent in California.
Diamond filed petitions for rehearing and for publishing the day after Christmas. On Wednesday, the court granted the petition for publication but denied the rehearing.
