Employer Not Liable to 3rd-Party Tortfeasor Under Theory of Implied Indemnity

The Arkansas Court of Appeals last week ruled that a telephone company had no obligation to provide indemnification to a third party who drove into a low-hanging wire and injured its employee. Although the Madison County Telephone Co. has a legal obligation to construct, operate and maintain its lines in a safe and reasonable condition, the court said an alleged breach of this general duty of care could not serve as the basis for the imposition of civil liability for Stuart Markley’s on-the-job accident.
