Supreme Court Upholds Apportionment of Recovery Between Worker, Lien

The Virginia Supreme Court ruled that a circuit court properly apportioned the funds available under an automobile liability policy between an injured worker and her employer’s lien. Savannah Padgett worked at a Shoe Department store in Suffolk. On Oct. 17, 2019, Mary Magdalene Brown crashed her vehicle into the store, injuring Padgett. The store had workers’ compensation coverage through Hartford Underwriters Insurance Co., which accepted liability for Padgett’s claim.
