An insurer breached its contract with a surgeon by paying him less than his billed charges, but it hadn’t acted maliciously in sending the invoice to a bill-review company, Iowa’s courts have decided.
Robert Milas sued Society Insurance after it tried to pay him roughly a third of what he billed for a spine surgery. The district court ordered Society Insurance to pay up, but it rejected Milas’ request for punitive damages. Milas appealed, but on Wednesday, the appellate court reached the same conclusion.
