The Missouri Court of Appeals ruled that a worker’s application for review was not untimely because the Division of Workers' Compensation failed to prove that it served him with notice of an order dismissing his claim.
The appellate court reversed a Labor and Industrial Relations Commission decision finding that John Tippit had received notice of the dismissal, saying DWC records showed that the order was mailed four days before it was entered, and it would be impossible to send an order before it existed.
