The Illinois Appellate Court ruled that the ex-wife of a deceased firefighter was not entitled to his pension benefits even though their dissolution of marriage was set aside. Gary Claxton began working as a firefighter for the City of Alton in 1978. In 1996, Claxton married. He and his wife entered into a prenuptial agreement in which both parties relinquished all claims to maintenance and the other party's retirement accounts or employment pensions, whether vested or non-vested, upon the dissolution of marriage or legal separation.
