A federal appellate court revived an injured worker’s claims of disability discrimination and retaliation against his former employer.
Jesse Sutherland began working for Peterson’s Oil Service Inc. in August 2019.
When Sutherland was hired, he negotiated with Peterson's so that he would not have to do installation work or cover night shifts. In exchange, Sutherland agreed to work Saturdays during the busy winter season.
Despite this agreement, Sutherland was assigned and completed installation work at least five times during his tenure at Peterson's.
