The California Supreme Court on Wednesday revived an employer's challenge to an award for a worker's back injury.
Goodwill Industries had sought judicial review of a decision by the Workers' Compensation Appeals Board finding Penelope Bembister Rieger had suffered a compensable injury while working as a Goodwill service coordinator, but the 4th District Court of Appeal summarily dismissed its petition as untimely.
The 4th DCA then asked the Supreme Court to grant review on its own motion.
