Appeals Court Misinterpreted Definition of 'Willful Misconduct,' High Court Finds

Workers who get hurt while behaving dangerously, recklessly and in deliberate defiance of managers' orders should have their workers' compensation claims denied, the Georgia Supreme Court wrote in an opinion published Monday. The court's decision in Chandler Telecom v. Burdette revolved around the question of what constitutes "willful misconduct." Under Georgia law, workers whose injuries arise from willful misconduct are barred from recovery.  The court did not say whether Adrian Burdette's actions on Nov. 5, 2012, constituted willful misconduct.
