New York’s highest court will weigh in on a family’s right to the remaining payments on a worker’s nonschedule permanent partial disability award in cases of death unrelated to a job injury.
The issue arose in a case called Green v. Dutchess County Board of Cooperative Education Services.
In March 2020, the Appellate Division’s 3rd Department ruled that Eric Watson’s teenage son could collect roughly $19,000 that remained outstanding on his award when he died in 2018.
