A California appellate court overturned an award of cost of living adjustments on an injured worker's permanent total disability payments, finding a judge had ordered them to begin too soon.

Facts: Charles Hart worked for the Town of Los Gatos as an engineering inspector. On Aug. 19, 2003, he slipped and fell while inspecting a construction site. The town accepted liability for a back injury.
Hart was off work for eight days before returning to full duty, but he missed 30 days in 2004....
