The Arizona House of Representatives on Thursday passed a bill that would presume parties agree to electronic service of documents such as subpoenas or legal summons.
The House voted 48-11 to pass HB 2033, by Rep. David Livingston, R-Peoria.
The bill would authorize transmitting documents electronically "in a manner reasonably calculated to achieve effective notice, unless the receiving party opts out by providing written notice to the other party."
Existing law allows electronic transmission, but only with the written consent of the receiving party.
