No Summary Judgment for Worker Allegedly Struck by Steel Beam

A New York appellate court ruled that a worker was not entitled to summary judgment on his Labor Law claim from being struck by a steel beam. Case: Heras v Ming Seng & Associates LLC, No. 2018-14542, 03/30/2022, published. Facts: Alvaro Heras allegedly was injured when a steel beam that he and a coworker were hoisting fell on him while he was working on a site in Flushing. At the time of the accident, Heras was employed by Jeaos Corp., and the premises were owned by the defendant Ming Seng & Associates LLC.
