Worker Not Entitled to Relief From Summary Judgment Due to Failure to Attach Affidavits

An Ohio appellate court ruled that a worker was not entitled to relief from a summary judgment that was entered after he failed to attach his evidentiary materials to his brief in opposition. Michael Farley worked for Old Dominion Freight Line Inc. He injured his foot at work in June 2003 and filed a workers’ compensation claim. The Bureau of Workers’ Compensation allowed it.
