The North Carolina Court of Appeals on Tuesday ruled that a taxi cab driver who was shot in the face by a passenger was not entitled to workers' compensation benefits because he was not an employee.
Refik Ademovic was an independent contractor for Taxi USA, the court said, reversing a contrary finding by the Industrial Commission.
Defense attorney Shelley W. Coleman of Hedrick Gardner Kincheloe & Garofalo – counsel for Taxi USA's comp carrier – said that Tuesday's decision shows just "how factually specific these cases are."
