A divided Oklahoma Supreme Court on Tuesday struck down yet another provision of the Administrative Workers’ Compensation Act as unconstitutional.
The high court has already invalidated multiple aspects of the AWCA in the law's four-year existence, including the sections that allowed employers to opt out of participation in the state workers’ compensation system; deferred awards of permanent partial disability benefits for workers who return to work; and limited the availability of compensation for workers with cumulative trauma injuries.
