The Kentucky Court of Appeals on Friday ruled that injured workers within the state have the right to choose the pharmacy where they get their prescriptions filled, since a pharmacy is a "medical provider" under the state's workers' comp scheme.
Although the Kentucky Attorney General arrived at a contrary conclusion seven years ago, the court said a "common sense reading" of KRS 342.020 dictates that an injured worker's right to choose his own medical provider extends to his selection of his pharmacy.
