Court Holds Workers Have Choice of Pharmacy Providers

The Kentucky Court of Appeals on Friday ruled that injured workers within the state have the right to choose the pharmacy where they get their prescriptions filled, since a pharmacy is a "medical provider" under the state's workers' comp scheme. Although the Kentucky Attorney General arrived at a contrary conclusion seven years ago, the court said a "common sense reading" of KRS 342.020 dictates that an injured worker's right to choose his own medical provider extends to his selection of his pharmacy.
