The New Jersey State Senate has approved a bill that requires claimant attorneys fees to be based on all benefits received by the client after a representation agreement is signed, not just the amount of the award that is in excess of the amount the claimant already received.
Senate Bill 2145 would amend Revised Statute 34:14-64 a(1)c to state that fees must be based on benefits paid “after the establishment of an attorney client relationship pursuant to a written agreement, and the amount of the judgment or award in excess of the amount of compensation, theretofore offered.” ...
