Ten states have now legalized recreational marijuana, and the National Council on Compensation Insurance has released a new report on pot's ramifications for workers’ comp.
One issue is how to determine whether marijuana has caused impairment that contributed to a workplace injury, and the impact on workers’ comp benefits if an employee tests positive.
According to report author Laura Kersey, tests are being developed that could help determine impairment, similar to Breathalyzer tests for estimating blood alcohol levels.
