Court Dismisses Challenge to State Smoke-Free Law

Iowa Attorney General Tom Miller announced that a lawsuit challenging the constitutionality of Iowa’s Smoke-Free Air Act has been dismissed in Polk County district court.District Court Judge Glenn E. Pille dismissed the lawsuit, which was filed July 1, 2008, by Choose Freedom Iowa, the Iowa Bar Owners Coalition, Clinton’s Organized Bar and Restaurant Owners, Froehlich Properties (doing business as “Fro’s”) and Ron Overson.Named as defendants in the suit were the State of Iowa, the Iowa Department of Public Health and Thomas Newton, department director.
