The U.S. Department of Labor proposes to amend Longshore and Harbor Workers’ Compensation Act rules related to penalties for employers that fail to report injuries.
Among other things, the proposed rules would cap at $28,304 the penalty for knowingly and willfully failing to submit required injury reports.
Penalties would be assessed as a percentage of the maximum fine depending on how many violations an employer has. The penalty for the first violation would be 5%. The percentage would double for each subsequent violation, being 10% for a second, 20% for a third, 40% for a fourth...
