The South Carolina Workers’ Compensation Commission issued an advisory notice outlining the procedures it uses to assess requests to disclose contents from claims files.
The WCC collects and stores personally identifiable information pertaining to all claims files, and the records are subject to a strict confidentiality statute. By law, commission records are available only to parties that have demonstrated an interest in and right to inspect them, and the state Supreme Court has clarified that the term “parties” refers to employees and employers.
