N.J. Assigns Three More Judges to Telephone Hearings; Indiana Extends Moratorium

States continue to roll with the punches on COVID-19 social distancing requirements and business shutdowns. Here's the latest from agencies in three eastern states.
Indiana: The Department of Insurance has asked insurers to extend a moratorium on policy cancellations and non-renewals until the end of May.
The department initially made the request in March, asking that the moratorium last until May 18. With the virus outbreak continuing, Insurance Commissioner Stephen Robertson has extended the request through May 31, he said in a bulletin Thursday.
“This moratorium is not a waiver,” he wrote. “It is only an extension of the period in which to pay the premium. The policyholder will have to resume making premium payments. The IDOI requests insurance companies work with the impacted policyholders in paying the premiums that would have become due during the moratorium period by either allowing a payment plan or a further extension in paying the amount due in full.”
Kentucky: All in-person hearings and benefit review conferences will remain canceled until further notice, Workers' Claims Commissioner Robert Swisher said in a bulletin. A previous directive had canceled in-person proceedings until May 17.
Administrative law judges may continue to utilize telephone and video conferences for proceedings, the bulletin said.
New Jersey: All compensation courts will remain closed to the public at least until May 26, but three more judges have been assigned to hear claims dispute cases via telephone or video conference, Chief Compensation Judge Russell Wojtenko said in notices posted Thursday and Friday.
In-person court proceedings will remain canceled except for a few emergency matters and ongoing motions for medical and temporary benefits, the judge said. Wojtenko in April had assigned 26 judges to hear cases telephonically or through video conference platforms. On Friday, he added three more to the list: Sarah Minor, Bridgeton; Gayle Loftis, Mt. Arlington; and Dawn Shanahan, Trenton.
Parties should contact the assigned court if questions arise. Filings will continue to be accepted through COURTS On-line, the e-filing system, the bulletin said.
