High Court: Workers' Comp Benefits Didn't Eliminate UIM Coverage

The Indiana Supreme Court, in a case of first impression, ruled last week that an auto insurance carrier could not wholly eliminate its liability to its insured for damages from a work-related car accident with an underinsured driver by offsetting the amount of his workers' compensation benefits from the amount of coverage owed under the policy.Indiana law requires that insurance carriers make underinsured motorist coverage available in limits of no less than $50,000, which was the coverage limit for Howard Justice's policy with the American Family Mutual Insurance Co.
