Facts: 712 Fifth Avenue Owner LP owns a building that was undergoing demolition and renovation. Angel Roman Caguana Rivera worked on the project.
He was directed to remove metal ductwork from the ceiling of a bathroom on the 35th floor of the building. Rivera was provided with an A-frame ladder to reach the ductwork 10 to 12 feet above the floor.
