A divided Missouri appellate court overturned a Labor and Industrial Relations Commission decision denying benefits for a nursing assistant who injured her knee while attempting to navigate a narrow space between a patient’s bed and a wall.
The commission said that because Sydney Durr would have been subjected to twisting and turning during normal daily activities, the twisting and turning that caused her injury in March 2015 was not causally related to her employment at Clark's Mountain Nursing Center.
