A New York appellate court ruled that a worker could move forward with his Labor Law claims for injuries from a fall from a platform above a moving train. Case: Devoy v. City of New York, No. 2018-10305, 03/03/2021, published. Facts: Brian Devoy worked as a laborer on the construction of a tunnel between Staten Island and Brooklyn. He allegedly suffered injuries while he was struck by the cargo a train was carrying, causing him to fall off an elevated platform and underneath the train.
