10th Circuit Revives Worker's Tort Claim Against Employer's Shareholder

The 10th U.S. Circuit Court of Appeals on Tuesday revived an injured truck driver’s tort claim against his employer’s parent company, ruling that a federal trial judge had misapplied Oklahoma law to find the parent company immune from liability. The case was Odom v. Penske Truck Leasing Co. Perry Odom had worked for Penske Logistics, a wholly owned subsidiary of the Penske Truck Leasing Co.
