The Pennsylvania Supreme Court has asked a lower court to decide whether its 2017 decision in Protz v. WCAB (Derry Area School District) applies retroactively, a move that could potentially impact the benefit status of thousands of workers.
In order to move forward with deciding Gillespie v. WCAB (Aker Philadelphia Shipyard), the high court wrote Thursday that it needs to know whether its decision in Protz — which struck down Pennsylvania’s impairment rating evaluation process — means that the IRE William Gillespie submitted to in 2007 is now void.
