The Maryland House of Delegates returned to the Senate an amended bill that would abrogate a recent court decision that expanded the scope of public sector employee benefit payments that can offset workers’ compensation benefits.
Maryland law allows the payment of certain benefits to employees of governmental units and quasi-public corporations to satisfy any workers’ compensation benefits owed to an injured worker. If the payment from the alternative benefit program is less than what someone would get in work comp benefits, the employer must make up the difference.
