Nine South Dakota legislators have thrown their support behind a bill that would create an affidavit declaring a worker to be an independent contractor and therefore exempt from the workers’ compensation law.
House Bill 1105, sponsored by Rep. Spencer Hawley, D-Brookings, would create a rebuttable presumption that the worker is an independent contractor. It follows a similar bill introduced in Nebraska that would create a process where independent contractors can apply to be certified as nonemployees.
