Business Owners Accused of Claim Denial Scheme, Premium Fraud

The owners and managers of a construction business were recently arraigned on multiple felony charges of workers' compensation premium fraud and payroll tax fraud in connection with a scheme to deny an injured worker's claim, the San Francisco District Attorney's Office announced.

Declan McKevitt, 47, and Grace McKevitt, 54, who own and manage An Dun Construction, are accused of underreporting payroll to their workers' compensation carrier and the Economic Development Department.

The alleged premium fraud and payroll tax fraud was discovered after a worker injured his hand on a table saw, resulting in an amputated finger.

Declan allegedly told the worker seeking medical care to deny that the injury was work-related. Additionally, he allegedly denied that An Dun Construction employed the worker and that the worker was at the jobsite without his knowledge. 

"This false denial of employment caused a four-month delay in payment of benefits owed to the injured worker," prosecutors said. "Payroll records and witness statements showed that this injured worker was employed by An Dun Construction for about seven months before the injury."

Declan McKevitt and Grace McKevitt on Friday pleaded not guilty to all charges and were subsequently released.

Both are scheduled to be back in court Oct. 15.
